Divorce: A divorce is a judicial decree which dissolves a marriage. The process will divide the assets and debts of the parties, determine custody of the minor children, provide for child support or possibly spousal support and give each person the right to remarry.

A divorce is not merely painful but has results which may endure for many years or even a lifetime. We file the necessary papers in court and immediately initiate formal and informal discovery to uncover the opposing party's assets, background, and other issues which may impact the case. A deposition of the opposing party almost always is taken and with the consent of the client, additional discovery including other depositions and third party discovery is conducted when necessary. The entire process and all efforts are designed to meet the goals and needs of the client and to resolve the case successfully. Sometimes a case is amenable to mediation which makes a trial unnecessary. We do not hesitate to utilize this mechanism when desirable.

Child Custody and Support: No area of domestic relations law can be more heart wrenching than a struggle over the custody of a child or children. We make every effort to separate the child from the case and to shield the child from the dispute. It is our firm's philosophy that children should not be involved in a custody suit with very few exceptions. In addition to engaging in informal and formal discovery, we seek to discover the relationship of the child to each parent, and the strengths and weaknesses of each party as a parent. We routinely obtain school records and seek information from teachers, child care workers, and physicians regarding the child and the parents. We search all court records, medical records and internet sites to discover any background information necessary to present or defend our case. If necessary, child psychologists can be retained to offer an expert opinion to the court.

The area of child support has significantly evolved over the past few years in Georgia. The determination of the amount of child support has become more involved and many factors other than income are considered by the court in determining the amount of child support to be paid by the noncustodial parent. Brown Law Office uses leading edge software to determine creative solutions in determining the appropriate amount of child support to be paid by the noncustodial parent and we are prepared to offer arguments to support both the custodial parent and the noncustodial parent.

Post Decree Modification: Circumstances of the parents and the child often change following a divorce, and it is necessary to seek to modify the terms of a divorce decree or agreement. The issues may relate to custody, child support, spousal support, or other issues. One of the most common causes of modification of custody is when one parent changes his or her residence to another state. With this change of circumstance both custody and visitation must be altered to meet the needs of the children and the parents.

Post Decree Enforcement (Contempt): Sometimes following a divorce a party fails to comply with his or her obligations set forth in the judgment of divorce. Grandparents Rights: In today's society grandparents are playing a more important role in the rearing and development of their grandchildren than ever before. It is not at all uncommon for grandparents to be solely responsible for rearing and supporting their grandchildren and to that end seek rights which will protect them or their grandchildren from the abrupt intervention of a parent or some other person. On the other hand it is all too common for a grandparent to obtain custody of a grandchild from a dutiful parent through trickery or artifice.
